GENERAL CONDITIONS OF SALE

These general conditions of sale (GCS) govern the purchase and sale of products on the www.theseaopportunities.com site between THE SELLER and THE CUSTOMER.

  1. EFFECTIVENESS OF THE GCS

These General Conditions of Sale (hereinafter GCS) constitute an integral and essential part of the purchase contract for any product, good and service present and sold on the website www.theseaopportunites.com   The Customer is required to read them before making any purchase.

The Customer can print and / or save these GCS, using the normal functions of his browser (eg: “Print” / “Save” / “Save page with name”). The customer can also download and save a copy of these GCS in PDF format by clicking here . Remember that in order to view the PDF file, the free Adobe Reader program must be installed on your computer (downloadable from the site  www.adobe.it  –  http://get.adobe.com/it/reader/?promoid=DAGCT ) or other programs that allow viewing of the PDF format.

The customer who makes a purchase on the website www.theseaopportunities.com , accepts these GCS.

Articles 6 (withdrawal) 7 (guarantee) of this contract apply only in the event that the customer can consider himself “consumer” pursuant to art. 3 Legislative Decree 206/2005 (consumer code).

 

 

  1. APPLICABLE LAW

The sale of the products and goods on the www.theseaopportunities.com site is governed by Italian law.

The possible invalidity of individual clauses of the GCS does not imply the invalidity of the remaining GCS.

 

  1. PROCEDURE TO MAKE THE PURCHASE

The Contract can only be concluded using the Italian and English language.

The purchase of the products – services presented on the site is subject to their availability.

To proceed with the purchase, the customer must follow the following steps:

2.Fill in the fields specifying which product and /or service you are interested in purchasing.

 

The customer after completing the purchase procedure, will provide to print or save  the contract in electronic form.

The seller will archive the contract in electronic form  and the data of the same will be accessible by the staff assigned by the SELLER to its complete or by any third parties appointed to fulfill. Therefore, by sending the order, the Customer authorizes the use by the  SELLER  of the data contained therefor the conclusion and execution of the supply of the Products and/or the service.

In the event of unavailability of the Products and/or service,

THE SELLER will provide to  inform the Customer as promptly as possible and refund any sums already paid and / or charged to him, without the Customer’s right to any compensation or compensation for damages.

 

  1. PRICE

The price of each individual product is indicated on the proforma invoice.  All prices are EXCLUDING VAT, unless otherwise indicated.

The final price can be paid by the customer by bank transfer.

In the event that the place of delivery of the product is located outside the Italian territory, the Customer may be subject to import duties and taxes, payable once the product reaches the specified destination. These additional customs clearance costs are charged to the Customer, since THE SELLER can not estimate or predict these costs as customs policies vary from country to country.

The costs of connecting to the www.theseaoportunities.com site are charged to the customer according to the TARIFF of the operator chosen by him.

 

  1. WITHDRAWAL 
  2.        a) The Customer can exercise the right to withdraw from the contract, without any penalty and without specifying the reason, within 14 working days from the receipt of the product.

The customer can exercise the right of withdrawal by sending notice of withdrawal by registered letter with acknowledgment of receipt to the SELLER. The communication of withdrawal can be sent, within the same term, also by telegram, e-mail and fax, provided that it is confirmed by registered letter with acknowledgment of receipt within the following 48 hours. The registered letter is considered sent in good time if delivered to the accepting post office within 14 working days.

The Seller will take care of the return of the product for which the withdrawal was exercised through its own carriers. Therefore, in the 14 days following the sending of the notice of withdrawal, the Customer must make the product available to the SELLER – intact and in the same conditions in which it received it – communicating to the SELLER the date and time slot in which he can deliver the product to the carrier appointed by the Seller.

If the product has been delivered, the  substantial integrity  of the product to be returned is an essential condition for exercising the right of withdrawal. The product must therefore be returned in a normal state of conservation, and must have been kept and possibly used with the use of normal diligence.

The only costs payable by the customer for exercising the right of withdrawal pursuant to this article are the direct costs of returning the goods.

If the customer does not intend to use the carrier made available by the Seller, he must return the product for which he exercised the withdrawal to:

The Customer undertakes to return the intact good, in the same conditions in which he received it and correctly packaged it.

Within 30 days of receipt of the notice of withdrawal, the SELLER will refund the sums paid by the customer.

  1.            b) Products for which the right of withdrawal cannot be exercised (Article 55 of Legislative Decree 206/2005)

For  chemical products, once the package has been opened,  the right of withdrawal cannot be exercised. In fact, the specific characteristics of these products, which lead them to deteriorate and / or alter rapidly, as well as making transport extremely dangerous, cannot be returned once the package has been opened and the seal broken.

For Thrusters and Motors,  once immersed in water , the right of withdrawal cannot be exercised.

For any packaged products and / or products tailored to the customer, it is not possible to exercise the right of withdrawal.

 

  1. WARRANTY

All products on the www.theseaopportunities.com site are covered, for consumers only , by the 24-month legal guarantee for lack of conformity, pursuant to articles 128 and following of the Consumer Code (Legislative Decree no. 206/2005). To take advantage of warranty assistance, the Customer must keep the invoice that he will receive upon delivery of the Products. In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts.

The warranty does not cover accidental damage and will be classified as null and void if unauthorized repairs or modifications to the Products are made.

Consequently, THE SELLER will not be liable for defects on products resulting from poor maintenance, incorrect installation, modifications or repairs carried out by the Customer without the written consent of the SELLER.

In the event of a lack of conformity of the product, the Customer has the right, without charge, to repair or replacement (within the terms indicated below and provided for by the Consumer Code), or to an adequate reduction in the price or to termination of the contract.

The Customer can request, at his option, the seller to repair or replace the goods, without charge in both cases, unless the requested remedy is objectively impossible or excessively expensive compared to the other.

The sale or repair must be considered excessively onerous if they impose unreasonable costs on the seller, taking into account:

  1. a) the value that the asset would have if there were no lack of conformity;
  2. b) the extent of the lack of conformity;
  3. c) the possibility that the alternative remedy can be performed without significant inconvenience for the Customer.

THE SELLER will repair or replace within a reasonable time from the request and without causing significant inconvenience to the Customer, taking into account the nature of the product and the purpose for which the product was purchased.

If the repair and replacement are impossible or excessively expensive or if the replacement or repair previously carried out has caused significant inconveniences, the Customer can request, at his option, a reasonable price reduction or termination of the contract.

The use of the asset is taken into account when determining the amount of the reduction or the amount to be returned.

A minor lack of conformity for which it is not possible or is excessively burdensome to carry out the remedies of repair or replacement, does not give the right to terminate the contract.

 

  1. ELECTRONIC WASTE

If the Purchaser purchases electrical and electronic products from the SELLER for resale within the European Union, then the Purchaser is responsible for the provision of means of disposal and demolition of the waste of such equipment in accordance with the applicable national legislation and the Directive 2012/19 / EU of the European Parliament and of the Council of 4 July 2012 on Waste Electrical and Electronic Equipment (WEEE).

USE OF COOKIES AND PRIVACY
